Professional Negligence

Whilst most professionals strive to do a good job for their clients, unfortunately all too often we come across situations where either this is not the case or where the professional has simply “messed up”.

We are regularly asked to advise in these instances and this can involve potential claims against a variety of experts including, for example, solicitors, barristers, architects, surveyors, accountants and numerous others.

Where a problem has arisen it is essential that the client receives advice from lawyers with good experience of dealing with professional negligence claims. These sort of claims are often far less straightforward than may seem to be the case at first glance and even if it is relatively clear that the professional has made a mistake that may not be the end of the matter. Often difficulties can be encountered in proving that the professional’s failure has actually caused any loss and the amount of such loss.

In most cases the professional will usually be represented by experienced lawyers acting on behalf of the professional’s insurers so it is essential that anyone bringing a claim is represented by experienced lawyers.

Many of the claims are resolved at mediation and here, Colman Coyle are able to bring extensive experience of the process to help clients achieve settlements to avoid the stress and uncertainty of a trial.

At Colman Coyle we have very considerable experience in successfully pursuing claims against a variety of professionals. This is also an area where, in appropriate cases, we are willing to act under a Conditional Fee Agreement.
